Affiliate Program Terms and Conditions
By registering for the Affiliate Program, you fully accept all the following terms.
1. Introduction to the Affiliate Program and How It Works
- How to Join: Any user can easily register for free on our website through the ‘Affiliate Registration’ or ‘Affiliate Program’ section.
- Sharing Links: After registration, each affiliate receives a unique referral link. They can share this link via friends, social media, WhatsApp, blogs, or any other medium.
2. Earnings, Commission, and Payment Process
- 2.1. Commission on Sales ONLY (NOT Clicks): It is explicitly clarified that commission is earned only on successful book sales, NOT on clicks or traffic. Merely clicking on the referral link or visiting the website will not generate any earnings. Earnings are recorded only when a customer successfully completes payment for a purchase.
- 2.2. Qualifying Sale: When a customer visits our website through an affiliate’s unique link and makes a purchase, that sale is considered a ‘Qualifying Sale’.
- 2.3. Commission: Upon successful payment, the system automatically credits the affiliate’s account with earnings (10% of the book price).
- 2.4. No Tax (on Low Earnings): The affiliate is NOT required to pay any tax to the firm on this 10% commission (as long as annual earnings are below Rs. 15,000).
- 2.5. TDS (Tax Deduction): If an affiliate’s monthly/annual earnings exceed Rs. 15,000/-, then as per the rules of the Government Income Tax Department, 5% TDS will be deducted, and the remaining amount will be sent to their account. At the end of the financial year, when the affiliate files their ITR Return, they can claim this 5% TDS back. This rule is issued by the Income Tax Department, so compliance is mandatory for the firm.
- 2.6. Returns/Refunds: If a customer returns a book purchased through an affiliate link or initiates a chargeback, the commission earned on that sale will be automatically debited from the affiliate’s account.
- 2.7. Transparency: Affiliates can view live records of their clicks, successful sales, refunds, and pending earnings in their dashboard (Affiliate Account).
3. Tracking, Cookie, and Attribution
- 3.1. Cookie Duration: Visitor activity will be tracked for 60 days after clicking an affiliate link. If the visitor makes a purchase during this period, the affiliate will receive a commission.
- 3.2. Attribution Rules: If a customer clicks on links from multiple affiliates, the sale will be attributed to the last-click affiliate.
4. Affiliate Responsibilities, Eligibility, and Legal Restrictions
- 4.1. Age: The affiliate must be 18 years of age or older.
- 4.2. Identity Documents: The affiliate must possess at least one government-approved identity and address proof document (Aadhaar Card/Passport/Voter ID/any valid identity proof).
- 4.3. Bank Account: The affiliate must have their own active savings bank account to receive commissions.
- 4.4. PAN Card: The affiliate must have their own valid PAN card (essential for TDS deduction).
- 4.5. FTC Disclosure: The affiliate is required to clearly disclose in any promotion (social media posts, blogs, videos) that they receive a commission on sales made through their link.
- 4.6. Strict Action on Fraudulent Documents: If documents submitted by the affiliate during registration (Aadhaar, PAN, bank passbook, or identity proof) are found to be fake, forged, tampered with, or photoshopped, it will be considered a serious offense. Full details and evidence will be immediately handed over to the Cyber Crime Police. Additionally, the affiliate will be sent a Show-Cause Notice and their account will be permanently closed without any pending payments.
5. Prohibited Activities
Affiliates are strictly prohibited from the following activities. If found engaging in any, the account will be terminated without warning and all pending commissions will be forfeited:
- Sending spam emails or messages.
- Placing deceptive or misleading advertisements (e.g., falsely claiming the book is free).
- Running Google/Facebook ads on our firm’s name, logo, or trademark.
- Cookie Stuffing or Click Fraud (giving fake clicks to oneself).
- Self-purchasing through one’s own referral link.
- Modifying or distorting any of our marketing materials (images, text) without permission.
- Using URL shorteners that bypass tracking.
6. Affiliate Data Privacy and Security
Your personal information security is our top priority. Therefore, the following privacy terms apply:
- 6.1. No Data Sharing: All personal information submitted during registration (e.g., name, address, mobile number, email, PAN card, bank account details, Aadhaar number, photo) will be kept strictly confidential. This data will NOT be shared with any third-party firm, other website, other affiliate, or any individual for marketing, sales, or any other purpose.
- 6.2. Protection of Contact & Address: Your personal contact number and home/office address will be kept only for our firm’s internal records, payment processing, and compliance with legal requirements (Court Orders). It will never be published or shared with other affiliates, customers, or the general public.
- 6.3. Data Access: Access to your data within our firm is restricted only to a few authorized staff members specifically required for account management, payments, and support. They are legally bound to maintain the confidentiality of this data.
- 6.4. Data Storage & Security: All your data is stored on our secure servers with high-level encryption. We adhere to modern security standards to prevent any data leaks or hacking.
- 6.5. Data Retention Policy: Even if you close/deactivate your affiliate account, our firm may retain your data securely for at least 5-8 years to comply with Indian Company Act and Income Tax Audit rules. However, during this storage period, the data will NOT be shared with third parties nor used for any other purpose.
- 6.6. Legal Obligation: The only exception is if a legal summons/subpoena is received from the Government of India or a Court; in that case, data may need to be shared for legal compliance. You will be notified beforehand.
7. Customer Data Privacy
Affiliates are NOT permitted to collect, store, or use the personal information (name, mobile, email) of any visitor or customer coming through their link. If found doing so, it will be considered a violation of the Data Privacy Act.
8. Intellectual Property
Affiliates are permitted to use our website images, book covers, and content solely for promotional purposes. However, they cannot claim any copyright ownership over this material.
9. Payment Date, Minimum Limit, and Process
- 9.1. Payment Date: The commission amount earned by the affiliate will be transferred directly to their registered bank account by the 10th of the following month.
- 9.2. Minimum Payout Threshold: Payment will be processed only when the account balance reaches a minimum of Rs. 500/- or Rs. 1,000/-. If the balance is lower, it will roll over to the next month.
10. Program Termination
- By the Affiliate: An affiliate can close their account at any time, but if the pending balance is less than Rs. 500 at that time, it will be forfeited.
- By the Firm: If the affiliate violates any rule (especially Sections 5 and 4.6), we reserve the right to close the account without any notice.
11. Support and Communication
- Official Communication: Any official notification from our firm will only be sent to the affiliate’s registered email ID. Communications via third parties will not be acknowledged.
- Support Hours: For any technical or payment-related queries, affiliates can email [support@timekeepersofthekings.com]. A response will be provided within 24-48 business hours.
12. No Guarantee of Earnings
The firm does not guarantee any specific earnings or sales to any affiliate. An affiliate’s earnings depend entirely on their promotional efforts, traffic, and marketing skills.
13. Account Transfer, Nominee, Dispute Management, and Succession Policy
- 13.1. During Lifetime: An affiliate’s account, ID, or pending earnings cannot be transferred, sold, or gifted to anyone else during their lifetime.
- 13.2. Role of Nominee: If an affiliate passes away, all pending balance in their account will be paid ONLY to the registered nominee.
Legal Fact: Under Indian law (especially banking and financial transactions), a nominee is considered a “receiver,” not the absolute owner of the amount. This means the nominee can take possession of the amount, but legal heirs (e.g., spouse, mother, father, children) can claim their share from the nominee in court. The court can, at any time, override the nomination or order the nominee to pay the amount to legal heirs. - 13.3. Dispute Before Payment: If before releasing the payment to the nominee, our firm receives a written complaint, legal notice, or court stay order regarding the claim from any other family member (mother, spouse, siblings, etc.), then:
- Our firm will immediately put the payment process for the nominee on hold.
- We will notify both parties (nominee and the claiming family member) in writing that the amount is held with us but will not be released until a court order or mutual NOC is received.
- If the dispute prolongs, our firm will keep the amount in our legal account (Escrow/Current Account) and advise both parties to resolve the matter through mutual negotiation or court proceedings. Our firm will not side with either party nor decide on releasing or withholding the money.
- 13.4. Dispute After Payment: If our firm has already released the full amount to the nominee after completing its procedure (as per rules in 13.5 – Death Certificate, Original ID, etc.), and another family member later claims the amount, then:
- All legal and financial liability of our firm is fully discharged.
- No liability remains on our firm. The dispute is solely between the nominee and the family members.
- Our firm will not be responsible for any mediation, appearing as a witness in the lawsuit, or court expenses. The nominee and family must resolve the matter themselves in court. Our firm shall be fully indemnified in this situation.
- 13.5. Advance Nominee Verification: To avoid all these disputes, every affiliate must submit the following documents of their nominee at the time of registration (or before the first payment):
- Valid Aadhaar Card (number and copy) of the nominee.
- Valid PAN Card (copy) of the nominee.
- Recent passport-size photograph of the nominee.
- Solid proof of the nominee’s relationship with the affiliate (Family Register, Notarized Affidavit, or Marriage Certificate).
- All documents must be self-attested by both the nominee and the affiliate; otherwise, they will not be considered valid.
- 13.6. Payment Procedure to Nominee: Our firm will release the amount to the nominee only when all the following conditions are met simultaneously:
- Official Death Certificate of the affiliate must be submitted.
- The nominee must appear at our firm’s office (or on a video call) with original Aadhaar and PAN cards for identification.
- The nominee must sign an Indemnity Cum Affidavit clearly acknowledging that they are receiving the amount as a trustee on behalf of the legal heirs, and if any other claim arises in the future, they will handle the dispute themselves, not involving our firm.
- Only after verification of all the above documents will the amount be transferred to the nominee’s registered bank account.
- 13.7. SIMPLIFIED & FREEDOM-BASED NOMINEE UPDATION POLICY:
- 13.7.1. Affiliate’s Right: The affiliate has the full right to change their nominee at any time during their lifetime without any hindrance.
- 13.7.2. No NOC/Old Nominee Consent: Obtaining written consent (NOC) or approval from the old nominee is NOT mandatory for the affiliate. The affiliate can nominate a new nominee solely at their own will, without asking the old nominee.
- 13.7.3. Valid Reason & Proper Documentation: Although the old nominee’s permission is not required, to prevent fraud, the affiliate must provide a written reason to our firm for changing the nominee. This reason can be marriage, divorce, death of a relative, or personal choice.
- 13.7.4. Mandatory KYC of New Nominee: By not requiring NOC from the old nominee, we will pay double attention to verifying the new nominee. To nominate a new nominee, the affiliate must resubmit all the following documents of the new nominee:
- Valid Aadhaar Card (copy)
- Valid PAN Card (copy)
- Recent passport-size photograph
- Bank account details of the new nominee
- Proof of relationship with the affiliate (Notarized Affidavit / Family Register)
- All documents must be self-attested by both the nominee and the affiliate; otherwise, they will not be considered valid.
- Even after receiving all documents, verification will be done via a call on the affiliate’s registered number, and the record will be stored to avoid future disputes.
- 13.7.5. Duty to Inform: It will be the affiliate’s duty to inform the old nominee in writing (Email/Message) about the change. Our firm (Proprietorship) will not take responsibility for conveying this information to the old nominee.
- 13.8. Final Disclaimer of Liability of our Firm (Proprietorship):
- Choosing a nominee, ensuring the authenticity of their documents, and providing correct family relationship information is the sole responsibility of the affiliate.
- Our firm is merely a Payment Processor. We will NEVER be responsible for any internal family disputes, fake nominees, mutual lawsuits between mother/spouse/children, or succession issues.
- If the nominee’s documents are not pre-registered, or if we get stuck in a legal notice before payment, the amount will be kept on hold with us and released only after a court decision or mutual agreement.
- 13.9. Grievance Redressal: If a dispute arises, a written complaint (Email) can first be filed at support@timekeepersofthekings.com. We will respond within 7 working days. If not satisfied, the dispute will fall under the jurisdiction of the courts in [Budhlada/Mansa].
14. Program Changes, Bonuses, Advances, and Reserve Policy
- 14.1. Amendments in Program Rules: Our firm may amend these rules, commission rates, or payment policies from time to time. Affiliates will be notified of any major changes via registered email at least 7 days prior. These changes will apply equally to all affiliates.
- 14.2. Special Bonuses & Festive Offers:
- To boost happiness and enthusiasm among affiliates, our firm may, at its sole discretion and without any obligation, announce special bonuses, extra commissions, or contests at any time (e.g., festivals, New Year, firm anniversaries, or special occasions).
- Not a Right: All these offers depend entirely on the firm’s will. No affiliate is permitted to demand these bonuses or consider them a right. If the firm does not offer a bonus on a festival, no questions or complaints can be raised.
- All bonuses will only be given to affiliates who meet the conditions (Minimum Sales, Active Status, etc.) set by the firm at that time.
- 14.3. Advance Payment in Emergency:
- Only for Genuine Emergencies: If an affiliate needs funds before the scheduled date (the 10th) due to a genuine emergency (e.g., serious illness of self or family, accident, natural disaster, or legal need), they can request an advance payment.
- Required Documents: For an advance payment, the affiliate must submit the following documents via registered email:
- Written request (Email Application) for advance payment.
- Clear reason for the emergency and amount required.
- Supporting proof of the emergency – e.g., medical report, hospital bill, FIR (Police Report), or written order from an official authority.
- The affiliate’s own Aadhaar Card and PAN Card (for identity proof).
- Process & Timeline: The firm will verify these documents. Upon approval, the required amount (or approved amount) from the pending commission will be transferred to the affiliate’s registered bank account within 24 to 48 hours.
- Note: Advance payment will be made only from the commission earned for that month at the time the mail is received. The firm will not send any advance amount to the affiliate’s account from its side.
- 14.4. Optional Reserve/Savings Fund for Affiliates: Considering affiliates’ future emergencies, this optional facility is provided:
- 14.4.1. Depositing Amount: If an affiliate voluntarily wishes to keep a certain percentage (e.g., 10%, 20%, or 50%) of their monthly commission with the firm as a ‘Reserve Fund,’ they may do so. This amount will be kept separate from regular payments.
- 14.4.2. Process to Create Reserve: The affiliate just needs to send a registered email expressing their wish, clearly stating:
- What percentage (%) of their monthly earnings they want to keep in reserve.
- For how long (e.g., 6 months, 1 year, or open-ended) they want to keep this reserve.
- 14.4.3. Withdrawal of Reserve: Whenever the affiliate needs it, they can request to withdraw their reserve amount (or part of it) simply via registered email. No reason is required for this, as it is their own savings.
- 14.4.4. Timeline for Transfer: Upon receiving a withdrawal request, our firm will transfer the amount to the affiliate’s registered bank account within a maximum of 24 to 48 hours.
- 14.4.5. Changing/Cancelling Reserve: The affiliate can increase, decrease, or completely cancel their reserve percentage at any time. They just need to send an email for this.
- 14.4.6. No Interest on Reserve: It is clarified that our firm will NOT pay any interest or bonus on this reserve fund. It is simply an amount kept safely for the affiliate’s emergency.
- 14.4.7. Reserve in Case of Death: If the affiliate passes away, this reserve amount, like regular commission, will be released to their registered nominee (as described in Section 13).
- 14.5. Right of Firm’s Discretion: In all the above points (14.2, 14.3, and 14.4), the firm has the full right to accept or reject requests, demand documents, or increase/decrease timelines. None of these facilities are a legal right of the affiliate, but an additional facility provided by the firm as a goodwill gesture.
15. Liability and Dispute Resolution
- Liability: The affiliate is an “Independent Contractor,” NOT our employee. They are solely responsible for any legal violations during their promotions.
- Dispute: If any dispute arises, attempts will first be made to resolve it through mutual dialogue. If unresolved, the court jurisdiction shall be [Budhlada/Mansa].
16. Physical Documentation, Appointment, and Office Formalities
This section contains all rules applicable for physical legal proceedings:
- 16.1. Physical Documentation Requirement: If any legal proceeding requires signing an original Affidavit, Physical Contract, or other paperwork with a wet signature, the affiliate must come to our office personally to sign these documents. Sending them by post or via a third party is not permitted.
- 16.2. Travel & Expenses: The affiliate must bear their own expenses (transport, accommodation, food, etc.) for visiting the office. The firm will not provide any compensation, allowance, or additional commission for this travel.
- 16.3. Appointment Mandatory: The affiliate cannot visit the office unannounced. An appointment must be made via email to support@timekeepersofthekings.com at least 3 working days in advance. Only affiliates with a confirmed appointment will be allowed entry into the office.
- 16.4. Original ID Verification: When visiting the office, the affiliate must bring their original identity documents (Aadhaar Card, PAN Card, and passport-size photograph) for cross-verification with the copies on file. Submitting photocopies/scans will not complete this process.
- 16.5. Digital Alternative – E-Sign: For the affiliate’s convenience, if permitted by Indian law (IT Act) and our firm’s policy, we may offer the option of remote signing via Aadhaar e-Sign or DSC (Digital Signature Certificate). However, if digital signing is not feasible for any reason (e.g., technical issues or legal restrictions), physical presence will be mandatory.
- 16.6. Supremacy of Physical Contract: If there is any contradiction between these Online Terms and a contract/affidavit physically signed at the office, the Physical Contract/document will be considered final, authentic, and legally binding.
17. Additional Legal Terms
- 17.1. Limitation of Liability: The affiliate shall fully indemnify and hold harmless the firm against any loss, expenses, claims, or legal actions (including attorney fees) arising from the affiliate’s breach of these terms, illegal activity, or negligence.
- 17.2. Entire Agreement: This Agreement, including all its schedules and incorporated policies, constitutes the entire and final agreement between the firm and the affiliate, superseding all prior oral, written, or electronic communications or understandings.
- 17.3. Use of Affiliate Links: Affiliates:
- (a) shall NOT run paid advertisements (PPC) on any search engine or social media platform targeting the firm’s trademarks, service marks, or name (including misspellings).
- (b) shall NOT promote affiliate links through pop-ups, pop-unders, or interstitial windows.
- 17.4. Relationship of Parties: Under this Agreement, the affiliate is an Independent Contractor. Nothing in this Agreement creates a partnership, joint venture, agency, franchise, or employment relationship between the firm and the affiliate. The affiliate has no authority to bind the firm to any legal or financial obligation.
- 17.5. Record Keeping & Audit: The affiliate shall maintain complete and accurate records of their website traffic, clicks, and sales for at least [2] years. The firm reserves the right, at its discretion, to audit the affiliate’s records upon reasonable notice to verify compliance with these terms.
- 17.6. Payment on Termination: If the firm terminates the affiliate due to a breach of these terms, no payment will be made for any pending commission, bonuses, or reserve amounts, and such amounts will be forfeited by the firm.
- 17.7. Confidentiality: The affiliate shall keep confidential any confidential information of the firm (including but not limited to commission structures, sales data, marketing strategies, and customer details). They shall not disclose this information to any third party without the firm’s prior written consent, nor use it for their own personal benefit.
